1. Acceptance of Terms

By accessing or using Blockhead Hosting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Service Description

Blockhead Hosting provides Minecraft server hosting services, including but not limited to:

  • Minecraft server hosting and management
  • Server control panel access
  • Technical support and assistance
  • Backup and restoration services
  • DDoS protection and security features

3. Account Registration and Security

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 13 years old (or have parental consent)
  • Not share your account with others
  • Notify us immediately of any security breaches

4. Acceptable Use Policy

You agree not to use our services to:

  • Host illegal, harmful, or offensive content
  • Engage in activities that violate applicable laws
  • Attempt to gain unauthorized access to our systems
  • Distribute malware, viruses, or harmful code
  • Engage in spamming or phishing activities
  • Use excessive server resources that impact other users
  • Host content that infringes intellectual property rights
  • Engage in harassment, hate speech, or discrimination

5. Payment and Billing

Payment Terms

  • All fees are due in advance and are non-refundable unless otherwise stated
  • Services are billed monthly or according to your selected plan
  • Prices are subject to change with 30 days notice
  • Failed payments may result in service suspension

Refund Policy

  • New customers may request a refund within 7 days of initial purchase
  • Refunds are processed to the original payment method
  • No refunds for partial months or add-on services after the 7-day guarantee period
  • Abuse of refund policy may result in account termination

6. Service Availability and Uptime SLA

Uptime Guarantee

We guarantee 99.9% monthly uptime for your Minecraft server. This guarantee is subject to the following terms:

  • Uptime is calculated monthly and excludes scheduled maintenance
  • Scheduled maintenance will be announced at least 24 hours in advance
  • Downtime due to customer actions or violations is not covered by this SLA
  • Downtime due to DDoS attacks exceeding our protection capabilities is not covered

SLA Credits

If we fail to meet our 99.9% uptime guarantee, you are eligible for service credits:

  • 99.0% - 99.8% uptime: 10% service credit
  • 98.0% - 98.9% uptime: 25% service credit
  • Below 98.0% uptime: 50% service credit
  • Credits are applied automatically to your next billing cycle
  • Credits cannot exceed 100% of your monthly service fee

Additional Support Services

  • Technical support via our ticketing system
  • Emergency maintenance as needed for security or stability
  • 24/7 infrastructure monitoring and automated failover

7. Data, Backups, and Migrations

Backup Services

We provide automated backup services as part of our hosting plans. However, you remain responsible for:

  • Maintaining additional backups of critical data
  • Ensuring your content complies with these terms
  • Data loss due to your actions or account termination
  • Verifying backup integrity and restoration procedures

Important: Our backup service is provided as a convenience and should not be relied upon as your sole backup solution. We retain the right to delete data from terminated or suspended accounts after 30 days.

Server Migrations

Free server migrations are provided between our data centers subject to technical feasibility and resource availability. Migration timing and success cannot be guaranteed, and some downtime may occur during the migration process.

8. Performance and Service Limitations

Performance Targets

Performance targets (including latency, storage speeds, and setup times) are typical performance metrics and may vary based on:

  • Geographic location and network conditions
  • Server load and resource utilization
  • Configuration complexity and customizations
  • Peak usage periods and maintenance windows

While we strive to meet advertised performance targets, they are not guaranteed service levels unless specifically stated in our Service Level Agreement.

Setup and Provisioning

Server provisioning typically completes within 60 seconds but may take longer during peak periods, for complex configurations, or due to technical issues requiring manual intervention.

DDoS Protection

DDoS protection is provided through our infrastructure partners and third-party services. Protection levels may vary based on attack type, severity, and duration. We cannot guarantee complete protection against all forms of DDoS attacks or zero-day vulnerabilities.

9. Service Definitions and Scope

Service Availability

  • Uptime calculations exclude scheduled maintenance and emergency maintenance
  • Performance metrics are measured from our infrastructure endpoints
  • Feature availability may vary by plan, location, and service tier
  • All guarantees are subject to compliance with our Acceptable Use Policy

Resource Limitations

Resource allocations (RAM, CPU, storage) are dedicated to your server but may be subject to fair use policies to ensure optimal performance for all customers. Excessive resource usage that impacts other customers may result in service limitations or suspension.

10. Intellectual Property

You retain ownership of your content. By using our services, you grant us a limited license to:

  • Host and serve your content
  • Perform necessary technical operations
  • Comply with legal requirements

You agree not to infringe on the intellectual property rights of others.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data. By using our services, you consent to the collection and use of information in accordance with our Privacy Policy.

12. Suspension and Termination

Account Suspension by Blockhead Hosting

We may suspend or terminate your account for:

  • Violation of these terms
  • Non-payment of fees
  • Illegal or harmful activities
  • Technical or security reasons

Voluntary Account Cancellation

You may cancel your account at any time through your control panel or by contacting support. Cancellation terms:

  • Cancellation prevents future billing but services remain active until the end of the current billing period
  • New customers may request a full refund within 7 days of initial purchase
  • No refunds are provided for voluntary cancellation after the 7-day guarantee period
  • All data will be retained for 30 days after account termination for recovery purposes

13. Limitation of Liability

To the fullest extent permitted by law, Blockhead Hosting shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business interruption
  • Service interruptions or outages
  • Third-party actions or content

Our total liability shall not exceed the amount paid for services in the preceding 12 months.

14. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Governing Law and Disputes
