DMCA Policy

1. Policy Overview

Blockhead Hosting respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond promptly to properly submitted takedown notices for content that infringes copyright.

This policy applies to all content hosted on our servers, including Minecraft worlds, modifications, plugins, and any other user-generated content.

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on our service in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with the following information:

3. Designated Copyright Agent

4. Our Response Process

Upon receiving a valid DMCA takedown notice, we will:

Step 1: Review (24-48 hours)

• Verify that the notice meets DMCA requirements
• Confirm the identity of the copyright owner or authorized representative
• Review the allegedly infringing material

Step 2: Action (Within 72 hours)

• Remove or disable access to the allegedly infringing material
• Notify the user who posted the material about the takedown
• Provide the user with a copy of the DMCA notice
• Inform the user of their right to file a counter-notification

Step 3: Follow-up

• Confirm removal with the copyright owner
• Document the takedown for our records
• Monitor for repeat infringement

5. Counter-Notifications

If you believe your content was wrongly removed due to a DMCA takedown notice, you may file a counter-notification. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that was removed and its previous location
• A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
• Your contact information (name, address, phone number, email)
• A statement consenting to the jurisdiction of the Federal District Court in your district
• A statement that you will accept service of process from the copyright owner who filed the original takedown notice

6. Repeat Infringer Policy

Blockhead Hosting maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may consider the following factors when determining whether a user is a repeat infringer:

• Number of DMCA takedown notices received
• Number of valid counter-notifications filed
• Pattern of infringing behavior
• User's response to previous takedown notices
• Willfulness of the infringement

Progressive Enforcement

• First offense: Warning and content removal
• Second offense: Temporary suspension (7 days)
• Third offense: Extended suspension (30 days)
• Fourth offense: Account termination

7. False Claims

Filing false DMCA claims is illegal and may result in:

• Liability for damages, including attorney's fees
• Perjury charges for false statements made under penalty of perjury
• Blocking of future DMCA notices from the sender

Please ensure your claims are valid and made in good faith.

8. Limitations

Please note the following limitations of our DMCA process:

• We can only remove content hosted on our servers
• We cannot provide legal advice about copyright law
• We cannot mediate disputes between parties
• We cannot restore content removed by valid DMCA notices without a proper counter-notification
• We do not monitor user content proactively for copyright infringement
